«They are extremely far away from the people»1

– Don’t worry! I do see that you worry! – Kiril Kulikov took a thin expensive cigarette, put it into his mouth and started lighting it. Suddenly the cigarette slipped out of his mouth and rolled under the table. Kulikov bent to get a precious attribute of a harmful habit.

I was looking at him with curiosity. It’s strange, why has this man decided that I worry? Outwardly it looked the other way: a falling down cigarette, a dark shirt and a dark jacket, fussy movements of Kulikov’s hands discarded with a hot June midday of 2010…  And at that very moment it dawned upon me: a deity, a people’s deputy, a priori thinking that all the plebeian milieu around him should tremble at him as he was a luminary, condescended to me at this meeting! The following haughty sentence of  Kiril Kulikov proved my suggestion:

– I belong to luzhnikovskie! These are Babakov, Kurochkin …2

Accident

Oleg Krapiva’s BMW stood second in the rightmost lane when the traffic lights showed red. It was a late spring evening. It was drizzling, and an on-board computer showed 5 degrees above zero outside.
Oleg was going to his friend Vadim in order to watch football on TV. It was already twenty minutes to ten, and he was hopelessly late for the beginning of the match broadcast.

At last, the traffic lights showed green. Suddenly somebody’s car engine roared, a silver Subaru Outback, which stood first in the leftmost lane, started with a jerk, smartly turned left through the oncoming traffic lane, onto Rusanovsky bridge, then before the bridge sharply turned right, jumped over the road curb onto the sidewalk and skillfully went down to the canal between two concrete barriers.

Forgetting about football, Oleg also turned left, parked his car near the bridge and rushed to the water. A silver Outback was already floating stern foremost towards the Dnieper river, and its bonnet almost sank. There were some people on Rusanovsky bridge, some other people were running down under the bridge. There were people crying around.

While Oleg went up the bridge, ran across it to the other side, Outback completely went down the water. There was a football, some pieces of paper floating around. Oleg started calling the police and ambulance over his mobile phone. The mobile clock shoed 21:45.

So far it was April 29, 2008.

While waiting for the arrival of emergency services, Oleg went to the place where a suicide car jumped over the road curb. There were bumper pieces, a registration number of the car lying about on the ground. Oleg automatically picked it up and so he was holding it in his hand until the police came.

Explanations of Oleg Krapiva

On April 29, 2008 Oleg Krapiva testified the following to the lieutenant Ganzha E.A., an inspector of road accident material registration department, who came to the scene of the accident:3

“On 29.04.2008 I was driving my car BMW… A car SUBARU was going from the side of Dneprovskaya embankment. When I went onto the bridge I saw that a car SUBARU flew away from the bridge in the rightmost lane. I saw a car SUBARU under the bridge in the water. After that I called the state road inspection”.

Explanations of Pavel Sklyarenko

On April 29, 2008 a witness Pavel Olegovich Sklyarenko testified with his hand to the same lieutenant Ganzha E.A.:

“On 29.04.2008 I was going on foot over the bridge with my friend from the side of Rusanovskaya embankment towards Dneprovskaya embankment. A car Subaru, the registration number of which I didn’t manage to keep in mind, was going from the side of Dneprovskaya embankment. It flew into the water after jumping over the sidewalk. In the water it was floating approximately in the middle of the bridge, when the car was already in the water, one of the passengers came up to the surface. After he floated to the other side of the bridge, he came down the water and didn’t come to the surface anymore. In ten meters the car sank completely”.

Explanations of Yevgeniy Slipukha

On April 29, 2008 Pavel Sklyarenko’s friend Yevgeniy Slipukha confirmed to the lieutenant Ganzha E.A. the following:

“On 29.04.2008 my friend and I were going over the bridge from the side of Rusanovskaya embankment towards Dneprovskaya embankment when I noticed a car which was going from the side of Dneprovskaya embankment. It was a car Subaru, the registration number of which I didn’t manage to keep in mind, which flew away from the road, struck against the sidewalk and flew into the water. Then it tided under the bridge, floated about 15 meters, when we saw a man (maybe it was a driver) coming up to the surface, then he came down the water again and didn’t come up to the surface anymore. As soon as we saw an accident, we called the ambulance and the state road inspection”.

Explanations of Valeriy Malenko

On April 29, 2008 Myrsky I.V., a police lieutenant, a detective of the Anti-drug-trafficking Organization in Dneprovsky District Department of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev, took oral explanations from a citizen Valeriy Vasilyevich Malenko.

Malenko orally testified “I have been working as a section leader of the 2 emergency-rescue department in the communal emergency rescue service since 2004. On 29.04.2008 an officer on duty of the Ministry of emergency situations of Ukraine received a call that there was a car going down the bridge on Rusanovskaya embankment.

On arrival at the scene of the accident it was found out that a car Subaru went down the bridge and fell into the water. On the view the depth for lifting works was measured. Diving works weren’t carried out as it was quite late and there was no equipment for diving works available”.

V.Myslovsky’s report

“To A.Statkevich, a head of Dneprovsky District Department of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev.

A report.

I report that on 30.04.2008 after receiving the instruction from an officer on duty of Dneprovsky District Department of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev I as a member of an investigation and operational group went to the address 1 Entuziastov Str., Kiev where according to the preliminary information a car Subaru flew away into the canal of the river Dnieper.

On arrival at the scene of the accident it was found out that a rescue team took out of the water from the river Dnieper a car Subaru Outback, registration number AA 7802 CM, a left rear window of which was smashed. There were no men or dead bodies inside the car found. It was found out that a car Outback belonged to the citizen Anna Vladimirovna Manko.

There were no witnesses of the accident found.

Myslovsky V.V., a police lieutenant, a detective of the Criminal Investigation Department TOM-3 of Dneprovsky District Department”.

From the car inspection report

“… there is no left rear window.

On the view of the inside of the car it is found that there is a wet dust, an empty cigarette pack “Davidoff” lying on the right front seat. The front dashboard is completely deformed, there is an airbag lying on the dashboard. There are … lying inside the glove box.

A report is made by Chyorstvy M.A., a senior police lieutenant, an investigator of the Investigation Department of Dneprovsky District Department.

30.04.2008”.

Just a little time passed. And on May 8, 2008 an investigator BaranivskyV.A. wrote the following decision:

V.Baranivsky’s decision

“Baranivsky V.A., an investigator of the Investigation Department of Dneprovsky District Department of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev, after considering the materials of pre-investigation inspection  from the Registration book of crime applications under the No. 8367 of 29.04.08.

ascertained:

At about 21:45 on 29.04.2008 a car Subaru, registration number AA 7802 CM, which was driven by an unidentified driver, who lost control of the above mentioned car, in Entuziastov Str. near the bridge over Rusanovsky canal crossed the road borders and went down into Rusanovsky canal.

As a result of this road accident a citizen Manko V.I. received bodily injuries and died.

The dead body of Manko V.I. was found on the territory of Goloseyevsky district of Kiev.

Taking into account that the above mentioned materials contained enough data showing the presence of crime features, following the articles 94, 98 and p. 2 of the art. 113 of the CCP of Ukraine,

I decided:

1.    to begin criminal proceedings according to the road accident, according to the features of corpus delicti, foreseen by the p. 2 of the art. 286 of the CC of Ukraine.

2.    to register the criminal case under the number No. 04-17817.

3.    to take over a case and to start investigation…”.

The investigation was carried out for some time. At last the case was suspended. And on November 28, 2008 after seven months of such a suspension the police officers took the following decision:

«I approve.

Vasilishen V.V., a police colonel, a deputy head of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev, a caretaker investigative department head.

Conclusion

About examination results of the suspended criminal case No. 04-17817 according to the art. 206 p. 3 of the CCP of Ukraine, started according to the p.2 of the art. 286 of the CC of Ukraine.

On 08.05.2008 a criminal case No. 04-17817 was started by the Investigation Department of Dneprovsky District Department of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev according to the road accident according to the art. 286 p. 2 of the CC of Ukraine.

It was found out that at about 21:45 on 29.04.2008 a car Subaru, registration number AA 7802 CM, which belonged to Anna Vladimirovna Manko, and which was driven by an unidentified driver, who lost control of the above mentioned car, in Entuziastov Str. near the bridge over Rusanovsky canal in Kiev crossed the road borders and went down into Rusanovsky canal.

As a result of this road accident a citizen Manko V.I. received bodily injuries and died.

On 30.04.2008 the dead body of Manko V.I. was found in the river Dnieper near the island Zhukov on the territory of Goloseyevsky district of Kiev.

The following investigative actions on the criminal case were carried out:

A long-term plan of carrying out investigative actions was made.

An additional view of the car Subaru, registration number AA 7802 CM, was carried out.

Manko I.L. was recognized as a victim and examined.

Slipukha E.S., Sklyarenko P.O. were examined as witnesses.

A forensic medical examination of the dead body of Manko V.I. was carried out.

In connection with this case all the necessary investigative actions were carried out, but there was no possibility to find out a person who committed this crime.

Taking into account all the afore mentioned facts,

I would consider that:

A decision on a criminal case No. 04-17817 about the suspension of preliminary examination in accordance with the p. 3 of the art. 206 of the CCP of Ukraine is recognized as justified.

Purlinsky D.Y., a senior police lieutenant, an investigator of the Investigation Administration of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev.

I agree: Matveykin S.V., a police major, a deputy head of the department of the Investigation Administration of the Central Administration of the Ministry of Internal Affairs of Ukraine in Kiev”

The only people who did not agree with the afore mentioned decision were a mother, a father, a sister and a brother of Manko V.I. who died.
